How did we not see this coming? Scott Brown has been running ads and all over Massachusetts talks shows telling everyone there is no way Healthcare can pass as long as he gets to the senate. He promises to be the 41 vote against and kill the measure. This did not matter much as he was Republican running in Massachusetts for Ted Kennedy’s seat. Then a Boston Herald poll said he was only behind 9 points a two weeks before the lection. Still this was not much of a concern until Rasmussen released a poll that said likely the keyword is likely voter showed Scott Brown trailing Martha Coakley by only two points. That woke Washington and sent the backdoor room deals scrambling. The new plan is to make sure if Scott Brown wins to hold up the official swearing until after the measure is pushed through the senate. This seems underhanded and almost impossible to orchestrate. If you think about it if Attorney General Martha Coakley did lose the vote would be close enough for her to ask for a recount and those wheels move slow. At every step of this Healthcare we have though there was a way to stop it. Every time we find a way to stop it they find a way to end around the plan. This last blow makes everything seem hopeless and 30 million people, who refuse to pay for covered like the rest of us, will get it and we will pay for them too.

It is that time of year again when we all do it. You make the resolution that this is the year you are going to work out more, you reup you membership to the gym, as you are all charged up to keep that promise. They will tell you this is not the reason but Democrats are running from reelection bids because they know they are dead meat. The latest surprise retirement is North Dakota Democrat Byron Dorgan. Dorgan who is 67 years old was elected to the Senate in 1992 after serving a dozen years in the House. He might have heard the foot steps of Republican Gov. John Hoeven who might have challenged him in November. He might have just realized that signing on to a Healthcare plan is like a kill shot to your career. North Dakota was not like Connecticut, Vermont and mid west neighbor Nebraska getting any sweet heart deals for support. This is a lifetime politician who is stepping down when his party is in complete control they own the White House. In politics they do not mourn your loss long as Democratic Rep. Earl Pomeroy, who was first elected to the House in 1992, could be interested in seeking the Senate seat, along with Heidi Heitkamp, a former state attorney general who was defeated by Republican Gov. John Hoeven in the 2000 gubernatorial race. The domino effect is in play if Pomeroy runs as that might open another seat in the House for a bid by a Republican. If this was not enough good news Dorgan has nothing to lose and since he represents a large oil and coal-producing state, he opposes the bill backed by the White House and Democratic leaders that would put a limit on heat-trapping pollution and would allow companies to swap valuable emissions permits. Dorgan instead has pushed an energy bill that would boost renewable energy production and oil drilling and wait to tackle global warming pollution.

House and Senate Democrats intend to avoid traditional procedures when they negotiate a final compromise on health care legislation. The play is to exclude Republican lawmakers and reduce their ability to delay or force politically troubling votes in both houses. There is an unofficial timetable that calls for final passage of the measure to coincide with President Barack Obama State of the Union address in February. The final compromise talks will be a three-way negotiation involving top Democrats in the House and Senate and the White House. This is par for the course after passing this mess in the dead of the night and then on Christmas Eve. So if you were waiting for a formal House-Senate conference committee, you know the method Congress uses to reconcile differing bills, do not hold your breathe. The new hope and change plan is to skip the formal meetings, reach an agreement, and then have the two houses vote as quickly as possible. They still need a 60-vote Senate majority to advance the final passage. Why should their be a committee and debate there are only hundreds of differences between the two bills, the House 1,990 pages, Senate 2,074 pages and the 383 pages of last-minute changes. The only hope is the dispute over a government-run insurance option, the House wants one, but the Senate bill killed it. Is this really any surprise based on the cloak of darkness this whole thing has been concocted under.

So much for thinking, the House Democrats were going to stand up and fight the Senate. Seem like they are giving up on a public option government insurance plan. That was only the biggest piece of the health care legislation that passed in their chamber. They did the Sunday show circuit saying that it is not dead, at the same time they conceded that the final bill needs to be affordable which does not sound like fighting words. The House and Senate meet next month to reconcile the two bills. The truth is the final law will look a lot more like the Senate version than the House version. The grossest statements were by Senator Arlen Specter of Pennsylvania the Benedict Arnold of the Republican party who pleaded that Republicans in Congress offer a vote or two especially the Senate, on bipartisanship. While we are all keep hoping that a few Democrats will stand up in the House that maybe did not before and stop this before it gets to President Obama’s desk. The worst part is finding anyone in congress with backbone. Nelson fought over abortion language then caved when Nebraska received free Medicare, nothing to do with abortion. The process is sickening what the rush is when the measure will not take effect until 2013. Here is to hoping 2010 the bill blows up and we start over from scratch with bipartisan support and public backed plan.

There is no Republican voting for healthcare reform and at least one moderate Democrat said the Senate compromise on abortion is unsatisfactory, raising doubts that reform can pass by Christmas. Nebraska Senator Ben Nelson is the key holdout on the health care bill. The Senate has been working round the clock trying to finalize the 10-year, nearly $1 trillion bill in time for a final vote on Christmas Eve. The problem is Nelson appears to be the only remaining obstacle to the 60 necessary votes. There are more rumblings as the gutted bill is watered down without a government-run insurance option to the ire of the liberals. The Senate is stuck as they have many wheels rolling as they work on HR 3326 for the Department of Defense and the HR 3288 appropriations bill. They are in recess until noon tomorrow so expect another long night. We are not sure when Healthcare reform will resurface but we are sure the phones and arm twisting that Nebraska Senator Ben Nelson is dealing with must be intense. It is a shame when the only smart sounding democrat is Howard Dean as he thinks they should blow the bill up as it is nothing more than a bail out for insurance companies. Is President Obama and his minions so blind with naked ambition that they want to win at whatever the cost? There is only one reason to pass this so President Obama can claim major legislation in his first year of office. It is sad that as he watches all the good will he built up being sucked away by his own hubris. He said himself to Charles Gibson that lynchpins Medicare, Medicaid and Social Security are going to bankrupt the nation. Are those major legislations by his Democratic heroes and who is trying to emulate for history? It is going to be hard to have a very Merry Christmas knowing the vacuum the democrats are legislate us into.

Today we should see some voting in the Senate as the debate continues on H.R. 3590, the $848B plan to expand health insurance coverage. Senators will begin voting on amendments today first up should be Senate Amendment 2791 submitted by Senator Barbara Mikulski the Democrat from Maryland and Senator Lisa Murkowski a Republican from Arkansas. This is to clarify provisions relating to first dollar coverage for preventive services for women. Next up should be Senator John McCain Republican from Arizona S11998 request to hear from the authors of this legislation as to how they can possibly achieve one-half trillion dollars in cuts without impacting existing Medicare programs negatively and eventually lead to rationing of health care in this country. The bigger new today is Senator Ben Nelson a Democrat from Nebraska is expected to introduce an amendment restricting abortion funding. Nelson, is a conservative Democrat, intends to introduce an amendment to the Senate health care bill that would add controversial abortion language similar to the Stupak amendment in the House bill. This was the lynch pin that allowed the House to pass their version and get the votes needed. The wheels are moving slow and the Senate will be in committees today to press Bernanke on fed policy and the administration new Afghanistan policy. There is also talk of a ethics committee meeting for looking into the Whitehouse party crashers. There is a lot going on and putting healthcare out in front might be difficult for the next couple of days. One can only hope that everyday that goes by we get closer to the measure losing support.

The first of the healthcare debate passed in the senate without much fanfare. There were no votes plenty of amendment ideas, and partisan outrage. Behind the scenes Monday evening as cast of characters assembled to strategize that included Harry Reid, Democrat Senator from Nevada the Senate Majority Leader and most responsible for the 2,074-page bill. The healthcare gang of six including Senator Max Baucus of Montana, Chief of Staff Rahm Emanuel, Interior Secretary Ken Salazar, Health and Human Services Secretary Kathleen Sebelius, and former Senate Democratic Leader Tom Daschle, If you remember President Obama choose Daschle first for the Health and Human Services Secretary after all he did write a book on healthcare. He withdrew his name over his failure to accurately report and pay income taxes. In true Whitehouse fashion, they gave the job to Kathleen Sebelius another tax cheat instead. Today there should be some amendments and some votes as the democrats need to secure 60 votes needed to pass this cornerstone of the Presidents administration. The bill itself is growing everyday as today it is reported to be a 10-year, nearly $1 trillion legislation. This will include a first-time requirement for most Americans to carry insurance, expands the Medicaid federal-state insurance program for the poor, and require insurers to cover any paying customer regardless of their medical history or condition. Typically the senate will go on holiday recess from December 21-January 4 based on passed years. This means there is only 14 days excluding weekends but do not be surprised with an up or down vote on Saturday December 19.

Tomorrow begins another big day in healthcare debate. The senate will roll back into session to begin floor debate. The good news it appears the 60 votes are just not there. This does not mean the Democratic coalition will not be swapping favors for support. This major hurdle has some democrats looking for tighter restrictions on abortion coverage and the government plan to compete with private insurance companies is removed. There is one thing we believe the 40 Republicans are not going to be any help. There was a rally yesterday where they touted the $848 billion over 10 years to plan that would gradually expand coverage to most of those now uninsured, ban denying coverage or charging higher premiums due to poor health. The self-employed and small businesses would be able to buy a policy in a new insurance market and older people would get better prescription coverage. The polls still say 58% want healthcare reform, less and 27% like what Washington has come up with. Because the wheels of the senate move slow Monday will see each side offering one amendment and there are no votes are scheduled. There are more than 40 senators on the two committees that originated the bill, so as we move forward many amendments are expected. Things like malpractice lawsuits, consumer choice, affordability, minority health and drug prices are sure to be amendment discussions. This will shape up as a big struggle either way and hopes to wrap it up by Christmas break are little far fetched.
