Sotomayor was wrong rules Supreme Court

The Supreme Court ruled Monday that white firefighters in New Haven, Connecticut were unfairly denied promotions because of their race. New Haven was wrong to scrap a promotion exam because no African-Americans and only two Hispanic firefighters were likely to be made lieutenants or captains based on the results, the court said Monday in a 5-4 decision. The city said that it had acted to avoid a lawsuit from minorities. In Monday’s ruling, Justice Anthony Kennedy said, “Fear of litigation alone cannot justify an employer’s reliance on race to the detriment of individuals who passed the examinations and qualified for promotions.” He was joined in the majority by Chief Justice John Roberts and Justices Alito, Scalia and Thomas. This is important at this time because this is reversing a decision that high court nominee Sonia Sotomayor endorsed as an appeals court judge. This is really the only judgment that is flawed in her justice career and it is fresh ammunition. The court said it will return September 9 with Justice David Souter retiring there would be only eight justices unless Sotomayor has been confirmed by then. This was a good move by the court not giving Sonia Sotomayor the awkward position of ruling on this motion twice. The bad news for New Haven based on her track record the decision might have went the other way 5-4.

The more we follow celebrities on Twitter the more we ask ourselves why we even like that person. Do not get us wrong it is not about the content but much more multisided than that. It can be things like, what they think is funny, what they think we should know, the image they are trying to project, or where their moral compass is set to. We know you probably want a few examples so how about Mandy Moore and the crocadoodle obsession or Mia Tyler and her need to tell everyone her twitterscope. We know there is no need to follow these people and then we would not have to read tweets from Tila Tequila as she rambles on every night about something controversial. Tila the reason you are limited to 140 characters is so you keep it short, seriously when you smash out four tweets to tell a story it is not microblogging. Then there are those who think the world should be a beautiful place and want only positive responses to their diatribe, this includes, Kristy Alley, Kathy Ireland, and Marlee Matlin. You always have this thought that if you meet a certain famous person you would love to ask them ___? It seems that when you see what some of these people are about you might not even want to meet them.

Pre is saving Palm

Palm had sold 300,000 Pre phones which are considerably higher than projected estimates and the company is struggling to keep up with demand. Based on these numbers moving forward Palm will now is produce 15,000 units a day. The bigger news is the expectation is Palm will ship one million phones to Sprint in the first full quarter of production. Palm will be looking to expand the market; right now they have an exclusive contract with Sprint for the Pre. The star of the Pre is the OS and can be laid on other versions of smart phones. The question at that time is if AT&T will sell the device head to head against the iPhone. Sprint advertising has been ramping up buying full page ads and using the tag line Your iPhone contract is up, Perfect timing. The Palm Pre does things the iPhone can’t. The Palm Pre does allow multiple applications to run at one time, this is something thew iPhone cannot do. When you are using an application it goes to full screen. The Pre can run two applications in a smaller set meaning you can play a game and monitor email at the same time.

Hollywood studios loses DVR battle

The Supreme Court back at work made a couple of decision today that is actually the right thing based on commonsense. They allowed the use of a new digital video recorder system that could make it cheaper and easier for viewers to record shows and watch them when they want, without commercials. The TV industry and in this case Cablevision Systems argued this kind of remote-storage DVR violates copyright laws. This is a standard response when anything artistic is being used by the consumer there way. The action means that Cablevision and other cable companies soon will be able to offer DVR service without need for a box in their homes. The remote storage unit exists on computer servers maintained by a cable provider. The President Obama administration had urged the court not to hear the case. They were not alone as The Screen Actors Guild, songwriters, music companies, Major League Baseball, the National Football League and the NCAA all sided with the networks and studios in asking for high court review. This of course does not mean a free service for consumers but programs would be stored on servers and played in an on demand capacity instead of coming off an internal hard drive. The cable company would need to licenses the content and space and storage would be an issue so cutting the commercials would give way to a leaner interface.

We do not want to throw Angelina Jolie out of the picture but Megan Fox is staking her claim to the kick ass chick in the movies that was resigned to Jolie and others. This weekend the movie Transformers 2 Revenge of the Fallen had the biggest debut of a June movie in history with a $112 million beating the first movie opening which was $70 million. These appearances by Megan as well as upcoming roles in Jennifer’s Body written by Diablo Cody that will release later this year are making her an even bigger star in Hollywood.

Bankruptcy of Clear Program leaves data exposed

Now that we have seen the shutdown of the Clear program which was run at airports by the Verified Identity Pass Company, there are concerns about who will keep the personal information, if it is protected or could it be sold to the highest bidder. There are over a quarter million peoples information in the system this includes fingerprints, Social Security numbers, eye scans, digital photos, home addresses and other personal information. They used the Clear program to speed them through airport security but now the company is out of business. Since there are members of congress on the list the bankruptcy proceedings and the information will be watched. Clear claims it has secured the personal information it gathered. Clear airport kiosks have been wiped clean of data. TSA has wiped their hands clean of having anything to do with the clear program. Somebody needs to step up here and it appears to be Homeland Security as the only government agency able to handle having this kind of information. The 260,000 members of Clear need to contact congress and force their representatives to make TSA and Homeland Security take care of this before time and information slips away.

Mississippi Governor Haley Barbour Get in the Ring

It is another Sunday and that means the morning news shows need to add a new name to the Republican for the presidency run in 2012. This of course needs to fill the vacuum left by Governor Mark Sanford of South Carolina who was a loud opponent of the stimulus package and confronting the President Barack Obama from the governor’s chair. After this week revelation that he has used federal funds to travel to a Trist to spark with a South American TV reporter his bid is over. This morning on the Face The Nation we added Mississippi Governor Haley Barbour on the short list of Republicans to run for the White House in 2012. He is a former national chairman of the Republican Party from 1993 to 1997, currently in his second term as governor of Mississippi. Oddly enough he also just became the head of the Republican Governors Association after South Carolina Governor Mark Sanford by his own admission stepped down. Prior to politics He has also worked as a lawyer and lobbyist. Governor Haley Barbour was awarded the Thomas Jefferson Freedom Award, which is presented to a nationally recognized leader by the bipartisan American Legislative Exchange Council. He was also named Governor of the Year for 2006 by Washington, D.C.-based Governing magazine; awarded the Gulf Guardian Award by the U.S. Environmental Protection Agency for his work to rebuild and protect sensitive Coast ecosystems; and received the 2008 Adam Smith Medal from BIPAC. He was born on October 22, 1947 and under Mississippi’s term limits, Barbour cannot run again for Governor in 2011 when his term ends. This put him in perfect line for a run at the White House.

Lenovo changes the keyboard

It is a constant, the keyboard, moving from typewriter to computer, to blackberry, to iPhone and it never changed. Then the genius at Lenovo after pouring a year of research decides to change the keyboard. They have come to the conclusion that what a laptop really needs is an extra-large “Delete” and “Escape” keys. This new feature will appear on the new ThinkPad T400s. Lenovo might have this the best time to move as the keyboard change has happened in the past with disastrous results. Last couple years in fact we saw that the seven inch netbook went by the boards because of the smaller keyboard. The ten inch model with a normal size keyboard seems to be a winner. The fact that device users have now become used to typing with thumbs on a Blackberry and fingertips on an iPhone could make a change easier. Lenovo made the two keys about twice as long in the vertical direction to fit the way people reach up, rather than to the side. The new design Lenovo claims will also cut down on accidental taps of the “End” and “Insert” keys based on the new layout.

President Obama getting ready to throw gauntlet

President Barack Obama is going to use executive order if he does not get his way in congress. The executive order will be used to indefinitely imprison a small number of Guantanamo Bay detainees considered too dangerous to prosecute or release. They have said if issued it would not take effect until after the October first to coincide start of the upcoming 2010 fiscal year. Congress has blocked the administration from spending any money this year to imprison the detainees in the United States. The administration has pledged to close the Guantanamo Bay prison in Cuba by January 21. This is the administration basically admitting that there are not really a lot of options for moving the prisoners to other countries. If he cannot get congress to play ball an executive order is the only route President Obama has to get the needed authority. There are 229 detainees currently being held at Guantanamo. If you are keeping count eleven are expected to be tried in military tribunals, Ahmed Ghailani, has been transferred to United States for prosecution by a civilian federal courts in Manhattan. Four Chinese Muslims (Uighurs) were transferred to Bermuda. The Obama administration is trying to relocate as many as 100 Yemeni detainees to Saudi Arabia for rehabilitation.
